What Is a Special Needs Trust?

A special needs trust is a planning tool designed for situations where a traditional will isn't enough. While a will distributes property after your passing, it may not protect assets for a loved one with a disability or preserve funds from long-term care expenses.

A special needs trust allows you to:

  • Protect assets while maintaining eligibility for government programs that support your loved one.

  • Provide financial support without jeopardizing benefits like SSI or Medicaid.

  • Preserve assets for other heirs, preventing long-term care costs from depleting the family's resources.

Without a special needs trust, families risk losing assets to government programs or nursing home costs, leaving little for the loved ones who depend on them.

In addition to a special needs trust, families should consider several other foundational documents:

  • Temporary Emergency Guardianships – Provides short-term care decisions for minors or dependents.

  • Revocable & Irrevocable Trusts – For managing assets during life and after death.

  • Asset Protection Trusts – Safeguard property from lawsuits or creditors.

  • Specialized Trusts – Real estate trusts, educational trusts, pet trusts, or NFA/gun trusts.

  • Business Structures – Creating an LLC to separate personal and business liabilities.

  • Government program details your loved one may rely on (e.g., SSI, Medicaid, state or community-based programs).

  • Names and contact information for your chosen agents under powers of attorney.
